Hawthorn are the employer so any claim against the AFL would be on the basis of vicarious liability. To establish that, AFL has to have prior knowledge of the issues, but maybe the facts are too murky/disputed on that issue. Much easier to go after Hawthorn. And for Clarkson, Burt and Fagan, claims against them are in their private capacity, so any outcome is against them personally.

Thanks, but as others have mentioned we found out during the saga that all playerâs contracts are tripartite agreements jointly with the player, club and AFL.
So donât see the need to let them off the hook so easily.
Cause this is a done deal already. The fix is in & the Hawks will be down for the count in the 1st round. Everything else is just scripted theatre for the masses
The players/families had said from the start they wanted changes to be made within the AFL to ensure what happened to them couldnât happen again. The various steps announced in the AFL press release, (but skipped in Gilâs statement - he said refer to the release for the details), are likely their best chance at seeing any change.
So coming to a settlement where they drop claims against the AFL in exchange for those institutional changes may have been considered a good enough exit from the internal investigation while now being able to go after Clarkson etc through a process that they canât just ignore.

Burt may have the most to lose in terms of a career. Heâs small fry, no longer in the AFL system .
If he is outside the scope of AFL sanctions, he could be the ideal scapegoat .
His future at Caulfield Grammar may not be bright.
Look at the EFC 34 - Any payments to the 34 come from EFC or the insurers - The AFL did not have to pay.
I understand the schoolâs brand is so important, but if Burt is still employed by Caulfield Grammar, I doubt this will change.
All the AFL wanted was to cover their own ass. Now that they have done that with a sham process of âintegrityâ they will move on and purge it from the football media. The families will need to go through the courts system, with the Voice debate raging they would be best doing it ASAP.
