Mental illness diagnosis would not prevent murder suspect from legally buying gun
DECATUR, AL (WAFF) -
Court documents reveal a Decatur woman accused of killing her husband was disruptive and unable to understand her initial court appearance.
According to the filing, a family member told the court 44-year-old Michelle Owens has been diagnosed as schizophrenic. During the hearing the judge appointed an attorney to represent Michelle.
Michelle is charged with the murder of her husband, Eddie Owens, who was 44-years-old.
The shooting happened June 26 at the family’s home on Lenox Drive in Decatur.
According to the 911 transcript obtained by WAFF, one of the couple’s children told a dispatcher he was afraid his mother shot his father and that she recently bought a gun.
Decatur police investigators are working to find out if Michelle legally bought the .38 caliber pistol they said she used to kill her husband.
From what has been revealed to this point, if she had been diagnosed as schizophrenic, that would not prevent her from legally buying a gun. Whether a doctor diagnosed her as mentally ill could come out in court but otherwise would be private information protected by HIPPA laws.
That is the same reason why a diagnosis would not be entered into the FBI’s National Crime Information Center database. Mental illness would only flag someone during a background check if someone has been involuntarily committed to a mental institution or found “not guilty” in court by reason of insanity or mental defect.
I read something last week that said American has been involved in a war somewhere all but 17 years over the last 248 or so years. Basically ever since they won their independence from the Brits, via a war.
Probably including wars against the Native Americans…but they had a very isolationist view for a very long time. No interest in the rest of the world until Teddy Roosevelt talked softly and carried a big stick…and that was largely as a mediator in the Russo-Japanese War in about 1905 and thereabouts.
