The FBI head has to be confirmed by the Senate, a simple majority iirc (if I have that wrong please correct me), given the circumstances that may not be a fait accompli. The GOP only needs to have 3 dissenting voices and they lose the vote if the Democrats are opposed.
If Comey cleared the President and his team most would believe it was a fair, impartial, and just decision. That may not be true of his successor, Trump may have inadvertently closed the door on being able to break free of this mess. Allowing the acting-Director to proceed unhindered would be a step in the right direction.
