Because O’Neil has mishandled it and been inept in her management of it. She didn’t preempt the HC decision and then let them all out. Then she was being led by Dutton to tougher legislation amendments.
And then claimed Dutton was protecting Pedos. It’s been a train wreck for Labor. Everyone knows it.

Two stages. Interim measures pending release of the HC reasoning. Those measures ( electronic bracelets , curfews, reporting to police) - applicable to all those released, irrespective of any criminal records - are being challenged.
From what is been made public through the media, the new bill provides for the Minister to apply to the Court for preventive detention on the basis of probability of reoffending in the case of those having committed a serious crime ( a sentence of 7 years or more) or a sexual offence. An assumption of recidivism leading to detention of 3 years or so.
Let’s see how the Courts handle this for non citizens if it doesn’t apply to citizens having committed comparable crimes.

He’s suggesting that, as the Murdoch press suggests, Labor should suffer electorally for an, in the current scheme of things, minor affair, in a major way as it’s the perfect whip for Dutton to get another race based dog whistling momentum up to wreck the government and divert their resources away from trying to govern.

Never mind it was the border police hero’s incompetence while in the job that’s led to repeat issues now being cleaned up with legislation - that other nasty foreign concept to the previous govt

No, it should’ve known what the HC decision was likely to be. It’s called scenario planning. It didn’t expect the outcome and it / we have paid the price. The government haven’t been focussed or strong enough and that supports the widely held view Labor isn’t strong on border control. And this is a live example playing out now.

I believe NZYQ (the person involved in the recent high court decision) arrived by boat when the Labor government was in power (Rudd was PM) and they tragically locked up over 30,000 in offshore detention. NZYQ was one of those 30,000

So Dutton had a decade to solve this problem but just kicked it down the road, sounds about right.

The 20 year legal precedent which the HC overturned was set back in the Howard Government time. Governments on both sides had relied on that legal precedent. The relevant individual NZQT arrived during the Rudd era.

Using your logic Rudd and Gillard should have sorted it out when they were PM

Your argument makes no logical sense. Let’s say the Government, pre-empting the High Court decision, made the wrong call.

They would be called out by the opposition for looking stupid, wasting money, a government that is panicking, the pre-emptive legislation may not even cover the High Court reasons for the decision … the resulting outcry would be pretty damaging.

It’s similar to seeing the speeding camera flash, then paying a speeding fine before any speeding ticket has issued, but not really knowing if it was you that had been actually speeding.

They just needed to wait so the resulting legislation can be done properly.

NZYQ is a Rohingyan, arrived by boat 2012 ( Gillard PM) , convicted of a sexual offence 2015, released on parole 2018 and placed in immigration detention . He is stateless and would probably have refugee status. He had been on a protected visa.
The one on a charge of indecent sexual offence against a woman at a hotel where he was staying, is a 65 yo Afghan refugee. He had been convicted in 2016 of assault on three elderly women in 2013 -2014, including one of indecent assault . He would probably have refugee status. It is unknown how and when he arrived. He has been refused bail.
Another one released, a 45 yo, was allegedly found to have cannabis in his possession while staying at a hotel in Sydney after his release.
It is understood all three had been fitted with ankle bracelets and subject to curfew.

The cannabis one is meh but the other two should never see the light of day again. If we can’t deport them then they stay in prison until they die

Yes but the Labor government should have seen this coming instead of letting the nation fall into degradation and ruin that it will never recover from.

A question for you:

Why is it that whenever someone makes an attack on the Liberals you very often immediately make a defense for them by pointing out Labor does it as well, yet the moment someone attacks Labor you make no effort to defend them?

Instead of making any attempt to defend Labor against dmaplestone’s attacks, in fact, you went to the effort to see how you could assist in blaming Labor.

Dutton’s solution was to create some detention islands to hold the detainees.

Brilliant…except for the fact doing that is unconstitutional.

And some people want that guy to come up the solutions…?

Andrew Wilkie introduced a Bill in 2021 to end indefinite immigration detention. It went nowhere.
