Its a shame that BRS does not end up in jail after these court proceedings and we have to have another costly trial. What an own goal!

Clearly I’ve no knowledge of defamation laws , but I do not understand how this has gone on so long.

Ultimately, The Age “truth” defence will stack up if/when BRS is charged with -and possibly convicted of - alleged war crimes?

Nah, the trial will be here. The Hague would only want to get involved if we were seen not doing the right thing.

Something like 45 (?) witnesses, they all have to give evidence and undergo cross exam - this can take hours, a whole day, even multiple days depending on the testimony

The defences they’re pleading are justification and contextual truth, which aren’t necessarily the same thing as what’s actually true. Justification is just proving that it is more likely than not, that A/B/C is true. But contextual truth is essentially them saying ‘hey even if we can’t prove B and C are true, what CAN be proven true in A is already so reputationally damaging that the rest doesn’t matter’.

Fairfax et al might actually win this case, but then BRS might be found innocent in a criminal trial. Justice system baby

Nick McKenzie leaving out the bits there and exaggerating the ones he has selected.
Bloke did not get arrested for being a war criminal, but for obstructing AFP in access to mobile data. He was given bail with a fairly low warranty, did not have to surrender his passport, seems free to travel back home to US and return for trial in June.
As to collusion of witnesses in falsifying evidence, the Judge decided to over rule his previous view that client privilege applied and that Defence counsel could now subpoena evidence of exchanges between Lawyers and certain witnesses.

And … something like all the evidence out in the public domain influencing the jurors perceptions against him in a criminal trial, unable to get a fair trial?
That one was tried in the Lehrman case, where the ACT system requires trial by jury for the alleged crime,

Nick McKenzie a smug slug, and I doubt BRS will ever be sent to trial for anything.

Odds on BRS being placed in handcuffs the moment he leaves the court after the judge rules?

No idea on part 2, but entirely in accord with part 1. The Saga showed us that.

Ok, well let’s hope that comes to pass.

Convicted of war crimes and it would be recinded. I can’t imagine anything less would be required.
