I think your forgetting that was the AFL vs us.
We were the enemy and anyone within the system treated us as such.

This is the AFL vs an outside entity, so the AFL community will move to protect their own image and the coaches and AFL media are toeing the company line.

Totally gross the treatment and lack of empathy for the vicrims, from near on all media personnel and AFL personnel.
The language used and propping up of “the embattled coaches and staff” has been really poor, it portrayed the families in negative light from the get go

why hasn’t ‘amy’s’ legal action begun yet? I wonder if it has or they waiting to do it collectively?

Kennett has called for a judicial inquiry.
That would seem to require approval by the Governor, acting on the recommendation of the Premier.
Others have mentioned action under the Racial Discrimination Act.

I doubt anything will come out of this investigation now or in the future - I POSTED at the time that I had doubts whether the affected parties would speak to any panel. Best could be something done within the Hawthorn footy club - Finally, I doubt any organisation will be prepared to take on this case, unless mandated by law such as a Court.

That level of insight sadly won’t be realised by the majority of the community. Inside or outside of the AFL.

They were probably waiting for this investigation to run its course to see what type of defence the coaches involved and the AFL would be potentially running in a court case.

Let them play their cards first, then establish your legal offence to attack their defensive weak spots.

From memory there were some demands made for what would be required for mediation, which included things like “truth telling,” “apologies,” and “reparations.” For that to happen Clarkson etc would have to essentially admit their guilt. The indigenous players could then take that admission to court and Clarkson/HFC would have a difficult time defending themselves. Of course Clarkson countered by saying he wanted copies of medical reports if he was to attend mediation, so it’s a bit of a stalemate.

I recently read that some indigenous families would attend mediation, but with Clarkson unlikely to attend, I doubt much will be achieved. However it puts the indigenous families in a light of “we’re trying to be reasonable, we’re trying to find a solution, we attended mediation” and by contrast makes Clarkson and whoever else doesn’t attend look unreasonable, unwilling to find a solution etc.

One of the mediation items was that all parties would cease all legal action.

It was “termination of all legal claims.” I don’t know if there’s scope to get around that by starting a “new” legal claim after the mediation, and the terms had been met re apologies, compensation fund, and reparations, there probably wouldn’t be need for legal action anyway.

Thus is going to end in a contradictory mess with Burt, Fages and Clakko exonerated yet Hawthorn paying out money to the victims

a court is not going to look favourably on parties that try to use an alternative dispute resolution method as some kind of pseudo hacky discovery process, instead of as a means to resolve the issue without litigation

mediation, done in good faith, would be the end of it

It’s done. No one is going to court.

The AFL have entered an alternate reality and established that the hawthorn football club acts independently of its employees that perform the acts. So they’ll sanction the club for racism but exonerate the hawthorn people that enabled and committed that racism.
