Spot on, KM. I was thinking exactly the same thing. @Finding_Nino never makes it personal. I like El Niño - even though I disagree with almost all of his ideas. He offered to give up an arm & a leg earlier for a flag. And I almost believe that he would do it. That’s passion.
I’ve worked a fair few harassment cases before & the point is - it doesn’t matter what the intentions of the perpetrator are. If one feels harassed or bullied, then they are harassed & bullied. And if they have indicated as such to a person, but it continues, then there can be very little doubt about it. It shouldn’t be defended or tolerated.

This comment isn’t related to Nino.
It does totally matter what the intentions of the perpetrator are. This is an internet forum. Opposing views will always come up. And sometimes it gets heated.
If the person being replied to doesn’t like the responses it doesn’t instantly make it harassment.
If somebody posts all the time and then decides they don’t like the responses of one particular person, that person doesn’t automatically have to stop.
Bullying should not be tolerated though. And that can be judged by moderators.

That proposition encapsulates everything that is wrong with the way bullying and harassment claims are dealt with. The alleged perpetrator’s intentions do matter, and so do the objective circumstances.

Opposing views are OK. Attack the position, not the person. When one makes it personal with insults & vitriol, etc, - it does matter & needs to stop.
I remember a senior manager I had to sack a long time ago for sexual harassment. He had been warned about making personal comments which a few of the ladies found uncomfortable. Things like “You look good in that dress. It shows off your assets well”. Now, he argued that he was passing a compliment & his intention was to point out that the dress suited the ladies height. The lady felt very uncomfortable & had repeatedly asked him not to comment on her appearance. But, he persisted. And she (and others) didn’t like his comments & found them to be sexually harassing. It only mattered what the ladies thought, not what the manager did. So, basically, it is up to Nino & the mods. Not us.
Ice mentioned that Nino had asked the person to stop, but they didn’t. If Nino feels harassed by that, then it matters. If he doesn’t, then so be it. Disagree, argue, whatever, but try & be respectful of others & recognise they there is a person behind the avatar. Don’t try & deliberately hurt them. And recognise that your comments may be interpreted poorly - even if there is no intent - if you make it personal.
