He’s doing a tremendous job of explaining how he was thinking through every step of what he was doing as he was doing it. If he gets found guilty, they should change the charge to intentional.

His entire argument can be countered by

  • used body as an anchor
  • pinned arms
  • outcome was head hit the ground.

He can argue his intention all he likes, but the outcome of his actions are clear. Even if we accept he attempted to exercise a duty of care, he still failed.

Good thing Dangerfield pinned both Walsh’s arms. Imagine how much worse it would have been if Walsh could have braced himself.

In that regard I think he is right, there shouldn’t be an expectation of releasing an arm in that circumstance.

However, when you do have a players arms pinned, they are in your control (Dangerfield states this himself). So when their head hits the ground, you did it, because they are in your control.

Using your body weight to drag them amplifies it and cedes duty of care.
