Legally, it doesnât. Functionally, when congress is cowering over the Epstein thing, and SCOTUS can be relied on to delay/defer/dodge any decision long enough to be implemented and the damage done, and the entire administration has been carefully selected for servility, then youâve got nobody prepared to arrest the slow slide into rule by decree.
The law has no power other than that which people choose to give it.

How effective playing with regulation etc where the executive orders do have lease is an open question. But as HM points out the brakes on Presidential power have rarely been weaker.
