Legally, it doesn’t. Functionally, when congress is cowering over the Epstein thing, and SCOTUS can be relied on to delay/defer/dodge any decision long enough to be implemented and the damage done, and the entire administration has been carefully selected for servility, then you’ve got nobody prepared to arrest the slow slide into rule by decree.

The law has no power other than that which people choose to give it.

Maxwells lawyer raises the possibility of a pardon publicly, but “we haven’t yet raised that with DoJ formally”.

Trump is asked about it. “I haven’t given it any thought, but I have the right to do it”.

How effective playing with regulation etc where the executive orders do have lease is an open question. But as HM points out the brakes on Presidential power have rarely been weaker.

Regardless, Murkowski is just putting on a very transparent show. Which is what I was actually getting at.
