Weren’t the ABC claiming that there was no settlement? Why are they then paying anything?

It’s not a settlement. It’s mediation + legal costs

Poor Porter, had to meet own legal costs apart from mediation. He is just on a Cabinet Minister’s salary, and Commonwealth not funding him - unlike Milligan, whose costs were ABC funded ( as she had ABC cover and clearance for her reporting).
If only Porter had sought Gov approval for his defamation action!

Even the ABCs own article uses the term ‘settlement’ which is stupid.

No damages were paid following the settlement of the case, but ABC managing director David Anderson said the public broadcaster had agreed to cover Mr Porter’s mediation costs of about $100,000.

Appearing before a Senate Estimates committee, Mr Anderson revealed the total cost of defending and settling the case had so far cost the ABC about $780,000.

“The total so far, both paid as well as accrued, is approximately $680,000, and that’s before the payment of $100,000,” he told senators.

“So costs incurred would be about $780,000 to the ABC.”

Also how does a meeting cost $100k?

I don’t have access to the Article, so I can’t see.

It’s just odd, that ABC were claiming that Porter withdrew, and that they were willing to fight.

Then this week, apparently they’re paying Porter’s legal costs.

Basically they paid 100,000/2=50,000 rather than paying 1,000,000+ to go to trial… and still kept the articles up etc.

EDIT: yes, they could have gambled on the judge telling Porter to pay all costs. I don’t know what the chance of that was.

Because as DJR posted above, it is better to pay that much in mediation fees and costs, rather than spend probably 5-10x that amount on legal fees during an actual trial, regardless of what the outcome is.

IIRC, Porter suggested mediation as the alternative to trial, possibly contingent on costs being met - there would be a heap of legal preparation before actual meeting and excruating drafting negotiatons on agreed mediation outcome
