Hard to understand how the term “war hero” and “Afghanistan” can be used in the same sentence.

Were some of the Nazi’s in Russia or the IDF in Gaza war heroes too?

Broke one of my cardinal rules this AM: I read an Andrew Bolt piece from beginning to end. No question there’ll be a price to be paid somewhere in the afterlife.

However.

It was a stunningly objective piece on the BRS charging and arrest. All the more so given the fawning support of most of his fellow travellers.

That’s not true, there were eyewitness testimonies from SAS soldiers and others on the missions.

Their statements will likely be tested again however under stricter criminal trial rules.

Luckily for him though he wasn’t able to document any of his alleged war crimes via TikTok like some of the world’s most moral soldiers do.

So having read the article, he is basically saying what I have said all along. I make no judgement on his guilt or innocence, I simply wait for the court to hear the evidence and make their ruling. If he is guilty, punish him, if he is innocent release him. Nothing more, nothing less.

You do realise the balance of probabilities requires evidence to be upheld. Right?

I would argue some German troops during WW2 were heroes. I would argue what BRS did for his medal was heroic.

You can do heroic things and do bad things other times, or be fighting for the wrong cause.

I just hope that this is a non jury trial. We need the expertise of a judge to reach a verdict.

The balance of probabilities is more likely than not to be true—meaning 50% plus 1.

Not actually requiring firm evidence.

I’m sure I heard it would more than likely be a jury trial. Plus

  • Constitutional Requirement: Under Section 80 of the Australian Constitution, trials on indictment for Commonwealth offences (such as war crimes) must be decided by a jury.

I would have thought war crimes would come under a seperate jurisdiction, but…huh.

That’s not how it works. To go from 50% to 51% requires …. evidence.

Ben Roberts-Smith is seeking public funding for his criminal defence after being charged with war crimes over the alleged murders of five unarmed detainees in Afghanistan.

The former Special Air Service corporal has applied for funding from the Afghanistan Inquiry Legal Assistance Scheme to cover his criminal defence, but has not yet received approval.
