Again, why was the waiver required / offered / asked for? The fact that this thing exists is absolutely damning on the club , player or both.
Yes, it’s a complex issue. That doesn’t alter the fact that the AFL already has procedures to be followed…

I’m not sure this is an accurate assessment.
Geelong have not negotiated any arrangement outside of the protocols - the protocols that are in place now to ensure player safety around concussion. I am sure geelong would have acted within those protocols for each individual player whilst still at the club.
What they have negotiated is an indemnity from any future laibility that arises in the future as a result of concussion from footy.
It is different.
But still wrong and they should be held to account.

I don’t have an issue with players / clubs signing away the risk with eyes open but what about the players who were forcibly retired who weren’t afforded this option

Something outside the protocols triggered them to make the waiver clause. Something made Geelong think it was needed. What was it? That’s the question.

It’s not a waiver. You can’t strike a contract which has the effect of you waiving your legal obligations.
well actually I guess you can, but would never hold up in a court
