I think she lacks the broad appeal necessary to carry a general election. Maybe that will change over time.

Establishment Dems already poisoned that well. She and “the squad” remain outsiders within their own party. She’s also deeply unpopular outside of Dem strongholds.

That’s an interesting comparison. In a failing political and economic ecosystem, one can see that there’s a new wave of U.S politicians trying to burn the system down for their own self interest, while the “old-guard” are wedded to the system as it exists while stubbornly refusing to reform it. These would compare to Yeltsin and his followers and the old communists respectively. What’s missing in the U.S for this comparison to work is a Gorbachev-style reformer, only one who wouldn’t accidentally burn the whole system down.

Adam Curtis called this “Hypernormalisation” in his 2016 documentary of the same name, where those who serve the system no longer believe in it.

While I don’t believe Biden has been as bad as his detractors on the left would believe, I’ve said before that he’s unfit for purpose with regards to what the U.S needs at the moment. He is still favoring capital over labor at every turn, which only makes more severe the underlying problems. He needed to recognize that the political landscape had changed, and he needed to be a reformer while using a firm hand on those involved with J6. He hasn’t.

Interesting dissent.

He states that a stay is not necessary because even if refused:

  1. it would merely reinstate the circumstances in existence before 2016 (in 2016 the FDA changed the rules around the drug to allow it to be administered from 7 wks (49 days) to 10 weeks (70 days), eliminated the requirement to report non-lethal safety events, permitted non-doctors to prescribe the drug, permitted a second dose of the medicine, allowed the drug to be given outside the office, and reduced the required office visits from 3 to 1 in order to receive the drug. In 2021, they allowed pharmacies to dispense it by mail);

  2. the FDA has not acted equitably and therefore is not entitled to an equitable remedy (a foundational concept of the law of equity is the doctrine of ‘clean hands’ - he or she who seeks equity must have ‘clean hands’; and

  3. lastly, there is no need for an urgent stay because the FDA’s case will be heard in 26 days and in any event the FDA won’t change anything/abide by the Texas ruling prior to the Federal Court appeal being heard.

I know there’s a bit of pantomime villainy in the reaction to the decision but it’s hard to disagree with the reasoning even if most of us would have come to a different decision.

The solution to the supreme court is one of two options, which are reasonably straightforward. The issue is both require control of the Senate.

  1. impeachment of current members
  2. expansion to add additional members

The second is the obvious one, but you need to remove the filibuster and have every single Democrat senator behind you.

Apart from what I stated, what other options do they have? If they don’t have the numbers in the Senate (which they probably don’t), how are they magically meant to “act mean” and make up for that?

Huh? So he thinks it’s ok to reset the rules back 7 years, for a time-critical treatment, and that is good reasoning? Why do the FDA not have clean hands? Why won’t they abide, or the Texas doctors/physicians, with the ruling in the meantime?
