You’re using essentially now mythical checks and balances as part of your “wait and see” position.

Congress can’t overturn an EO. All they can do , if they object to an EO, is draft a new statute to make the EO definitively illegal in a court of law. To do this, they need a majority in Congress , and a 2/3rd’s majority in the Senate to avoid Trump simply vetoing the new statute. Given that the Republican party has essentially ceased to exist and the entire ■■■■ show is demonstrably now a Trump cult, the theoretical protections no longer have any meaning in the real world. The lunatics have the numbers and as every other country in history has found, any system is inevitably bypassed if you have enough lunatics in the key positions.

Likewise the protection via the Courts. Ultimately, everything will end up in front of Scotus , and Coney-Barretts somewhat surprising recent divergence aside, all signs point to Scotus being a mere rubber stamp of Trump.

And these things will take years anyway. In the meantime, government agencies are already acting on the intent of most of these EO’s . They aren’t waiting for Congress approval. They don’t need it, because that’s not congresses role. Congress has to actually oppose them and then act in opposition. And whilst one or two are stuck in lower courts, the majority are not. And even when a ruling does go against them , they ignore it. “Wait and see” has just deposited several plane loads of deportees in El Salvador despite a Judges instruction.

So the “let’s wait and see” idea simply looks the other way from what is happening, and seeks solace in protections that now exist only as a thought experiment rather than reality, whilst this mob set about dismantling whatever ones remain.

The 2001 AUMF order which Bush used to go to war in Afghanistan and Iraq is still in effect. It was never repealed, and never expired. Trump has more than a sufficient fig leaf to go to war with whoever he wants, whenever he wants, regardless of Congress.

Well seeing the young black demographic and Hispanic demographic basically got him in I’d be surprised if this is the case.

But who knows with Trump.

Why would you be surprised? He is using every demographic which voted for him; he cares about none of them. And they can’t change and vote him out next time because he doesn’t plan on leaving.

The president can’t use an executive order to sidestep those checks and balances, and the president can’t take over powers from other branches, such as the power vested in Congress to pass new statutes or in the courts to invalidate certain laws as unconstitutional.

As of March 25, this no longer applies. Holman the border tsar said judges cannot stop him.
A judge would have to use the Marshall’s service to enforce a court order as I understand it. Will a US Marshall try and enforce an order and risk the sack? The DOJ will act against such orders. They cannot arrest Trump and he can pardon anyone he likes. Checks and balances are on the way out, if not already out the door.
